Terms of Use

These terms of Use (“terms”) govern your access to and use of Hostex services, including the website located at https://hostex.io and its subdomains (the “Website”), the Hostex mobile application (the “App”), and all related software, features, products, and services provided by Hostex (collectively, the “Services”).

Please read these terms carefully before accessing or using the services.

By creating an account, accessing, or using the services, you agree to be bound by these terms. If you do not agree with these terms, you must not access or use the services.

Hostex reserves the right to update or modify these terms from time to time. Any changes will become effective when published on this page, unless otherwise stated. Your continued use of the services after any changes means that you accept the updated terms.


1. About Hostex Services

Hostex provides software tools designed to help short-term rental operators manage their properties and operations, including but not limited to:

  • Property management tools;
  • Channel synchronization;
  • Reservation management;
  • Guest communication automation;
  • Operational management features;
  • Financial management tools;
  • Third-party integrations.

Hostex is a software service provider only. Hostex does not own, operate, manage, or control your rental properties, guests, reservations, transactions, or relationships with third-party platforms.

You remain solely responsible for:

  • Managing your properties and rental operations;
  • Complying with applicable laws and regulations;
  • Communicating with guests;
  • Setting prices, policies, and availability;
  • Obtaining required licenses, permits, and approvals;
  • Handling disputes with guests, owners, OTAs, or other third parties.

Hostex does not guarantee any specific business results, revenue, occupancy rate, booking volume, guest satisfaction, or financial outcome through the use of the services.


2. Definitions

For the purposes of these terms:

“Hostex”, “we”, “us”, or “our” means the provider of the services.

“User”, “you”, or “your” means any individual or entity accessing or using the services.

“Account” means a registered Hostex user account.

“Subscription” means a paid plan granting access to certain services.

“User Content” means any information, data, materials, files, images, documents, messages, or other content submitted, uploaded, transmitted, or stored through the services.

“Third-Party Services” means services, platforms, applications, integrations, or providers that are not operated or controlled by Hostex.


3. Access to the Services

Hostex grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the services in accordance with these terms.

You are responsible for making all arrangements necessary to access the services, including:

  • Internet connection;
  • Compatible devices;
  • Required software;
  • Account credentials.

Hostex may modify, suspend, restrict, or discontinue any part of the services where reasonably necessary for:

  • Maintenance;
  • Security;
  • Technical improvements;
  • Legal compliance;
  • Business operations;
  • Protection of Hostex, users, or third parties.

Hostex does not guarantee that the services will always be available, uninterrupted, error-free, or compatible with all devices or systems.


4. Account Registration and Security

Certain features require you to create an account.

When creating an account, you agree that:

  • All information provided is accurate, complete, and up to date;
  • You will maintain the confidentiality of your login credentials;
  • You will not allow unauthorized access to your account;
  • You are responsible for all activities performed through your account.

You must promptly notify Hostex if you become aware of unauthorized access or security issues involving your account.

Hostex is not responsible for losses resulting from your failure to maintain appropriate account security.


5. Subscription Plans and Payments

Certain services require payment of subscription fees or other charges.

By selecting a paid subscription, you agree to:

  • Pay all applicable fees;
  • Provide accurate payment information;
  • Authorize Hostex or its payment processors to charge applicable fees;
  • Maintain a valid payment method during your Subscription period.

Subscription fees are charged according to the pricing and billing cycle selected at the time of purchase.

Unless otherwise required by applicable law or expressly agreed by Hostex:

  • Subscription fees are non-refundable;
  • Paid fees cannot be credited, transferred, or exchanged;
  • Failure to use available services does not create a right to a refund;
  • Downgrading, cancellation, or account closure does not automatically entitle you to reimbursement.

You are responsible for selecting a Subscription plan appropriate for your business needs.


6. Refund Policy

Hostex generally does not provide refunds for payments that have already been processed.

However, in exceptional circumstances, Hostex may, at its sole discretion, consider providing a partial refund, credit, or other adjustment.

Any refund consideration:

  • Is evaluated individually;
  • Requires approval by Hostex;
  • Does not constitute an admission of liability or wrongdoing;
  • Does not create a future obligation to provide refunds in similar situations.

When determining whether to provide a refund, Hostex may consider factors including:

  • The unused portion of the Subscription period;
  • Actual usage of the services;
  • Third-party costs incurred by Hostex;
  • Payment processing fees;
  • Administrative costs;
  • Currency conversion costs;
  • Other reasonable expenses.

Where a refund is approved, any non-recoverable costs or fees may be deducted from the refund amount.

Refunds, if approved, will generally be issued through the original payment method used for payment.


7. Account Credits and Prepaid Balances

Certain Hostex features may require prepaid balances, credits, or usage-based payments.

You acknowledge that:

  • You are responsible for maintaining sufficient balances required for features you choose to use;
  • Certain features may not operate if required balances or payment conditions are not satisfied;
  • Account credits are not equivalent to cash and cannot be exchanged for cash unless required by applicable law.

Hostex may provide tools such as balance notifications or automated recharge options where available. However, such tools are provided for convenience only and do not constitute a guarantee that all services, third-party services, or reservations will be activated under all circumstances.

You remain responsible for ensuring that your account meets applicable requirements for the services you use.


8. Third-Party Services and Integrations

Hostex may integrate with or provide access to third-party platforms, applications, and service providers, including but not limited to online travel agencies (“OTAs”), payment providers, messaging providers, automation providers, and risk management providers.

Your use of any third-party services may be subject to additional terms, conditions, privacy policies, and requirements imposed by those third parties.

You acknowledge and agree that:

  • Third-party services are operated independently from Hostex;
  • Hostex does not control, guarantee, or assume responsibility for the availability, performance, accuracy, or reliability of third-party services;
  • Third-party providers may modify, suspend, restrict, or discontinue their services at any time;
  • Certain Hostex features may become unavailable or limited due to changes or failures of third-party services.

For features provided through third-party providers, including risk management, damage protection, or similar services, eligibility, coverage, terms, and decisions are determined by the relevant third-party provider. Hostex does not provide insurance, guarantees, or direct protection coverage unless expressly stated.

Hostex is not responsible for any losses, damages, or disputes arising from:

  • Third-party service failures, interruptions, or limitations;
  • Third-party decisions, policies, or requirements;
  • Your failure to comply with third-party requirements;
  • Fees, charges, or obligations imposed by third-party providers.

You are responsible for reviewing and complying with the terms and requirements of any third-party services you choose to connect with Hostex.


9. User Responsibilities

You are responsible for your use of the services and all activities conducted through your account.

You agree that you will:

  • Use the services only for lawful purposes;
  • Provide accurate and complete information;
  • Maintain appropriate security for your account;
  • Ensure that your use of the services complies with applicable laws and regulations;
  • Obtain all necessary rights, permissions, licenses, and authorizations related to your properties, guests, data, and content;
  • Maintain appropriate backups of information that is important to your business;
  • Review and verify information before relying on it for business decisions.

Hostex provides software tools only. You remain responsible for making independent decisions regarding your rental operations, including pricing, availability, guest screening, communications, property management, and compliance obligations.


10. Acceptable Use Policy

You must not use the services in any manner that:

  • Violates applicable laws or regulations;
  • Violates these terms or third-party rights;
  • Compromises the security, integrity, or availability of the services;
  • Causes unreasonable harm, disruption, or risk to Hostex, other users, partners, or third parties.

You must not:

Account Misuse

  • Create an account using false, misleading, or fraudulent information;
  • Access another user’s account without authorization;
  • Share account credentials with unauthorized persons;
  • Attempt to bypass usage limits, payment requirements, or service restrictions.

System Abuse

  • Reverse engineer, decompile, modify, or attempt to extract source code from the services;
  • Introduce viruses, malware, harmful code, or other malicious materials;
  • Attempt unauthorized access to Hostex systems or related infrastructure;
  • Interfere with the operation, security, or performance of the services;
  • Conduct scraping, automated extraction, or data harvesting without authorization.

Improper Business Conduct

You must not:

  • Use the services to engage in fraudulent, deceptive, or unlawful activities;
  • Submit false information or misleading claims;
  • Abuse Hostex support channels;
  • Threaten, harass, intimidate, or engage in abusive conduct toward Hostex employees, contractors, or partners;
  • Use the services in a manner that creates unreasonable legal, operational, financial, or reputational risk for Hostex.

Hostex reserves the right to investigate suspected violations and take appropriate action in accordance with these terms.


11. User Content

The services may allow you to upload, submit, store, transmit, or manage User Content.

You retain ownership of your User Content.

By submitting User Content through the services, you grant Hostex a limited, worldwide, non-exclusive license to access, process, store, reproduce, transmit, and use such content only as necessary to:

  • Provide and operate the services;
  • Maintain and improve the services;
  • Provide customer support;
  • Protect security and prevent abuse;
  • Comply with legal obligations.

You represent and warrant that:

  • You own or have obtained all necessary rights to submit your User Content;
  • Your User Content does not violate applicable laws or third-party rights;
  • Your use of the services does not violate agreements with guests, property owners, OTAs, or other parties.

Hostex does not verify or guarantee the accuracy, legality, completeness, or reliability of User Content provided by users.

You remain solely responsible for your User Content and any consequences resulting from its use.


12. Removal of User Content

Hostex may remove, restrict access to, or disable User Content where Hostex reasonably believes that such content:

  • Violates these Terms;
  • Violates applicable laws or regulations;
  • Infringes the rights of any third party;
  • Contains misleading, fraudulent, abusive, or harmful information;
  • Creates security, operational, or legal risks for Hostex, other users, or third parties.

Hostex may also remove or restrict access to User Content where necessary to protect the integrity, security, or proper operation of the Services.

Where required or appropriate, Hostex may cooperate with lawful requests from authorities or third parties regarding User Content.


13. Intellectual Property Rights

All intellectual property rights in and to the services, including but not limited to:

  • Software;
  • Website;
  • Mobile applications;
  • User interfaces;
  • Designs;
  • Logos;
  • Trademarks;
  • Documentation;
  • Technology;
  • Features and functionality;

are owned by or licensed to Hostex.

Except as expressly permitted by these terms, you may not:

  • Copy, reproduce, modify, distribute, sell, sublicense, or commercially exploit any part of the services;
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the services;
  • Create derivative works based on the services;
  • Remove, alter, or obscure any proprietary notices;
  • Use Hostex trademarks, logos, or branding without prior written permission.

Any unauthorized use of Hostex intellectual property may result in immediate suspension or termination of access to the services and may lead to legal action.


14. Suspension and Termination

Hostex may suspend, restrict, or terminate your access to the services in accordance with these terms.

Suspension or Termination Due to Violation

Hostex may immediately suspend or terminate your account if Hostex reasonably determines that you:

  • Violate these Terms or any applicable agreement;
  • Violate applicable laws or third-party rights;
  • Engage in fraudulent, deceptive, abusive, or unlawful conduct;
  • Misuse the services or attempt to circumvent technical, security, or payment restrictions;
  • Create security, legal, operational, financial, or reputational risks for Hostex, its partners, or other users.

Termination of Business Relationship

Hostex reserves the right to discontinue providing services to any user where Hostex reasonably determines that continuing the business relationship is no longer appropriate, practical, or commercially reasonable.

Such circumstances may include, but are not limited to:

  • Hostex is unable to provide services that reasonably meet the user’s requirements or business needs;
  • Repeated unreasonable disputes, demands, or claims;
  • Excessive or inappropriate use of support resources;
  • Abusive, threatening, or harassing communications;
  • Conduct that negatively impacts Hostex’s reputation, business operations, employees, partners, or other users;
  • Circumstances where continued service creates unreasonable business, security, compliance, or reputational risks.

Hostex’s decision to discontinue services under this section is based on business and operational considerations and does not require a finding that the user has violated any specific law.

Nothing in this section limits a user’s right to submit legitimate complaints, provide lawful feedback, or exercise rights available under applicable law.

Effect of Termination

Upon suspension or termination:

  • Your access to some or all services may be immediately restricted;
  • Connected integrations, features, or account functions may become unavailable;
  • You must stop using the affected services;
  • Any outstanding fees or obligations incurred before termination remain payable.

Termination does not affect rights, obligations, or liabilities that arose before termination.

Refunds Upon Termination

Termination does not automatically entitle you to a refund.

Unless otherwise required by applicable law, any refund following termination is provided solely at Hostex’s discretion and does not constitute an admission of liability, wrongdoing, or breach of these Terms.

Where Hostex terminates services or discontinues a business relationship, Hostex may, at its discretion, issue a refund for unused prepaid subscription fees or unused account balances after considering applicable circumstances, including any costs, fees, obligations, or losses incurred by Hostex.


15. Service Availability and Changes

Hostex continuously develops and improves the services.

Hostex may modify, update, replace, suspend, or discontinue any part of the services, including:

  • Features;
  • Functions;
  • Integrations;
  • Technical requirements;
  • Service availability.

Where reasonably practical, Hostex may provide notice of significant changes.

However, Hostex does not guarantee that:

  • Any particular feature will remain available indefinitely;
  • The services will always be compatible with third-party platforms;
  • The services will operate without interruption or errors.

Temporary interruptions may occur due to:

  • Maintenance;
  • Software updates;
  • Security measures;
  • Internet failures;
  • Third-party service interruptions;
  • Events outside Hostex’s reasonable control.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the services are provided on an “as is” and “as available” basis.

Hostex does not provide warranties or guarantees regarding:

  • Availability or uninterrupted operation of the services;
  • Accuracy, completeness, or reliability of information provided through the services;
  • Business results, revenue, bookings, occupancy, or profitability;
  • Performance of third-party services;
  • Prevention of all errors, losses, disputes, or operational issues.

You acknowledge that:

  • Software may contain errors or limitations;
  • Internet and third-party systems may experience interruptions;
  • Business decisions made using the services remain your responsibility.

Hostex does not act as:

  • A property manager;
  • A travel agency;
  • A booking platform;
  • An insurer;
  • A payment processor;
  • A legal, tax, or business advisor.

You are responsible for obtaining independent professional advice where necessary.


17. Third-Party Platforms and External Links

The services may include integrations, links, or connections to third-party platforms, websites, applications, or services.

Hostex does not control and is not responsible for:

  • Third-party content;
  • Third-party policies;
  • Third-party availability;
  • Third-party transactions;
  • Third-party decisions.

Your use of third-party platforms is subject to their own terms and policies.

You acknowledge that changes, restrictions, suspensions, or failures of third-party platforms may affect the functionality of Hostex services.

Hostex is not responsible for losses arising from third-party platforms or services.


18. Limitation of Liability

To the maximum extent permitted by applicable law, Hostex and its affiliates, officers, employees, contractors, partners, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the services.

This includes, without limitation, damages resulting from:

  • Loss of revenue, profits, business opportunities, or anticipated savings;
  • Loss of data or business information;
  • Loss of reputation or goodwill;
  • Business interruption;
  • Costs of obtaining replacement services;
  • Guest disputes, cancellations, claims, or complaints;
  • Property damage, theft, or losses related to your rental operations;
  • Failures, limitations, or decisions of third-party platforms or service providers.

To the maximum extent permitted by law, Hostex’s total aggregate liability arising out of or relating to the services or these terms shall not exceed the total amount of fees paid by you to Hostex during the twelve (12) months immediately preceding the event giving rise to the claim.

The limitations in this section apply regardless of the legal theory on which a claim is based, including contract, tort, negligence, strict liability, or any other basis.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, willful misconduct, or other mandatory legal obligations.


19. Indemnification

You agree to defend, indemnify, and hold harmless Hostex and its affiliates, officers, employees, contractors, partners, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use of the services;
  • Your violation of these terms;
  • Your violation of applicable laws or regulations;
  • Your User Content;
  • Your rental business operations;
  • Your relationship with guests, property owners, OTAs, payment providers, or other third parties;
  • Any dispute, claim, or liability arising from your properties, reservations, or services provided to your guests.

Hostex reserves the right to assume exclusive control of the defense of any matter subject to indemnification, and you agree to cooperate with such defense.


20. Privacy and Data Protection

Your use of the services is also governed by Hostex’s Privacy Policy.

You are responsible for ensuring that your collection, processing, storage, and use of personal information, including guest information, complies with applicable privacy laws.

You acknowledge that Hostex may process information on your behalf as necessary to provide the services.

Hostex may collect and process information including:

  • Account information;
  • Usage information;
  • Technical information;
  • Information necessary to provide integration and features.

Hostex will handle personal information in accordance with applicable privacy laws and its Privacy Policy.


21. Confidentiality

During your use of the services, you may receive or access confidential information relating to Hostex, including:

  • Technical information;
  • Business information;
  • Product information;
  • Pricing information;
  • Internal documentation.

You agree not to disclose or use confidential information except as necessary to use the services or as required by law.

Confidential information does not include information that:

  • Is publicly available without breach of confidentiality;
  • Was lawfully known before disclosure;
  • Is independently developed without use of confidential information;
  • Is lawfully obtained from another source.

22. Governing Law and Dispute Resolution

These terms and any dispute arising from or relating to the services shall be governed by the applicable laws of the jurisdiction where Hostex operates, without regard to conflict of law principles.

Before initiating formal legal proceedings, both parties agree to make reasonable efforts to resolve disputes through good-faith communication.

Nothing in these terms prevents either party from seeking remedies or protections available under applicable law.


23. Notices and Communications

Hostex may provide notices relating to the services through:

  • Email;
  • In-app notifications;
  • Website announcements;
  • Other reasonable communication methods.

You are responsible for maintaining accurate contact information associated with your account.


24. General Provisions

Entire Agreement

These terms, together with any applicable subscription terms, policies, and agreements published by Hostex, constitute the entire agreement between you and Hostex regarding the services.

Severability

If any provision of these terms is determined to be invalid or unenforceable, the remaining provisions will remain effective.

No Waiver

Hostex’s failure to enforce any provision of these terms does not constitute a waiver of its right to enforce that provision later.

Assignment

You may not assign or transfer your rights or obligations under these terms without Hostex’s prior written consent.

Hostex may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, or transfer of business.

Force Majeure

Hostex shall not be liable for any failure or delay in performing its obligations caused by events beyond its reasonable control, including but not limited to:

  • Natural disasters;
  • Government actions;
  • Internet failures;
  • Cybersecurity incidents;
  • Third-party service interruptions;
  • Labor disputes;
  • Other circumstances beyond Hostex’s reasonable control.
